Welcome to The Hide Guide. By accessing or using our website thehide.guide and the The Hide Guide mobile application (together, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement.

2. Account Registration

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to provide accurate, current and complete information during registration.
  • You are responsible for all activity that occurs under your account.

3. Acceptable Use

You agree not to:

  • Submit false, misleading or fabricated wildlife sighting data.
  • Upload content that is illegal, harmful, threatening, abusive or otherwise objectionable.
  • Attempt to gain unauthorised access to the Service, other accounts, or connected systems.
  • Use automated tools to scrape, crawl or bulk-download data from the Service without prior written consent.
  • Interfere with or disrupt the Service or its infrastructure.

4. User Content

When you submit sighting data, photographs or other content ("User Content") you retain ownership of your original work. However, by submitting User Content you grant The Hide Guide a worldwide, royalty-free, non-exclusive licence to use, display, reproduce and distribute it in connection with operating and improving the Service.

You represent that you own or have the necessary rights to submit any User Content and that it does not infringe the rights of any third party.

5. Third-Party Data

The Service incorporates wildlife observation data from third-party sources including eBird, the National Biodiversity Network (NBN) Atlas and the Global Biodiversity Information Facility (GBIF). This data is provided under the respective open-data licences of each provider. We do not guarantee the accuracy, completeness or timeliness of third-party data.

6. Intellectual Property

All content, design, graphics, software and other materials that form part of the Service (excluding User Content and third-party data) are owned by or licensed to The Hide Guide and are protected by copyright and other intellectual-property laws. You may not copy, modify or distribute these materials without our prior written consent.

7. Availability & Changes

We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may modify, suspend or discontinue any part of the Service at any time without notice.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, The Hide Guide disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

Wildlife data displayed by the Service is for informational purposes only and should not be relied upon as a sole basis for conservation, land-management or safety decisions.

9. Limitation of Liability

To the fullest extent permitted by law, The Hide Guide shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.

10. Termination

We may suspend or terminate your access to the Service at our discretion, without prior notice, if you breach these Terms or engage in conduct that we consider harmful to the Service or other users. Upon termination, the provisions of these Terms that by their nature should survive (including Sections 4, 8, 9 and 11) will remain in effect.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to These Terms

We may revise these Terms from time to time. The revised version will be indicated by an updated effective date at the top of this page. Continued use of the Service after changes constitutes acceptance of the new Terms.
